Louisiana Energy Protection Act is Necessary for the State

Louisiana’s energy sector drives growth, builds and sustains communities, funds public services including coastal protection, and provides hundreds of thousands of high-paying jobs. As competition for investment increases across the nation and beyond, Louisiana must ensure policy protects what it has built. That is exactly why House Bill 804 by Representative Brett Geymann should become law.

HB 804, the Louisiana Energy Protection Act, establishes clear guardrails against a troubling trend of frivolous climate lawsuits. The bill promotes the production and consumption of energy, while protecting energy producers and users from politically-motivated lawsuits seeking massive damages. The bill prohibits responsibility from being assigned to anyone for global climate change impacts, while still allowing legal action if a company violates conventional environmental laws, permit rules or workplace safety standards.

To reiterate, HB 804 does not create immunity for bad actors. Companies that disregard environmental regulations will still be held accountable for actual pollution and direct damages. The legislation prevents the absurd lawsuits that attempt to assign local liability for global climate emissions. HB 804 provides clarity and consistency where it is much needed.

Opponents predictably, and incorrectly, label this legislation as catering to special interests. That claim ignores the economic reality of the Pelican State. Energy is not a special interest in Louisiana, but rather the foundation of the state’s economy. With legal uncertainty, the consequences are severe. Investment slows, projects are stopped and jobs are put at risk. The knock-on impacts of those realities are enormous – upon landowners, the service industry, and the next generation of energy-hungry industries including data centers.

The Louisiana Energy Protection Act should be understood as economic protection for the entire state. Louisiana competes daily with other states and countries for energy and manufacturing projects. Investment decisions depend on predictability. If Louisiana fails to control its legal environment, it sends a signal to investors that projects are safer elsewhere. On the other hand, standing up against frivolous legal action intended to scare businesses away from Louisiana not only shows state leadership is committed to supporting the economy, but it makes Louisiana a trailblazer on this issue – ahead of Texas!

The legislation clearly reinforces an “all-of-the-above” energy strategy that has served Louisiana well. From traditional oil and gas to emerging technologies, the state’s strength rests in its ability to support a full spectrum of energy development.

The choice for Louisiana is straightforward. The state can either strengthen its position as a global leader in energy production or lose ground to more competitive locations. HB 804 is a practical bill that protects jobs, encourages investment and provides certainty without sacrificing accountability for any true bad behavior.

The Louisiana Legislature should act decisively and pass HB 804. It is a pro-business, pro-energy policy that protects not just an industry, but the economic future of the entire state.
